This Privacy Notice governs how Smart Communications Inc. (SMART) processes your Personal Data when you apply for SMART career opportunities or job vacancies and the corresponding steps as you progress throughout the hiring process. This Privacy Notice explains how your personal data is collected and processed when you use the Career Site (https://careers.pldt.com.ph/).

Search for potential candidates whose Candidate Profile match a certain job vacancy in SMART. In case Your Profile is a match, SMART Recruiter will reach out to the data subject and invite him/her to apply for said opportunity.

·         Professional License/Certificate (if any)

·         Org & Affiliations (if any)

·         Work Experience

·         Education

·         Within the legitimate interest of SMART as a business and an employer

 

·         The legitimate interest being pursued by SMART as the hiring employer is to continuously acquire enough manpower and appropriate skills to drive its business.

 

The rights and freedoms of the data subject is not harmed given that (a) the creation of Career Site Account and Candidate Profile are purely voluntary; (b) the Privacy Notice shall be set up to inform Candidates of the purposes of processing; and (c) the Candidates are given the opportunity to delete its own personal data submitted through Candidate Profile or its Career Site Account.

 

·         Data subject’s consent, in relation to processing of Sensitive Personal Information.

·         Relatives by blood or law to an employee under PLDT Group of Companies (if any; Name, Relationship, Department)

·         Ongoing application with any PLDT Group company

·         Job application source

·         Necessary in order to take steps in entering an Employment Contract with the data subject as signified by the job application submitted by the data subject

 

·         Data subject’s consent, in relation to processing of Sensitive Personal Information.

For assessments conducted through an online platform, the results are generated by and extracted from said online platform which is contracted by PLDT assessment purpose only.

 

Job Applicants

 

If you are not selected for the initial screening or you decided to withdraw your application, SMART will retain your information for 6 months from the time of your application.

·         Result from the background investigation conducted by a third-party by SMART.

·         Pre-employment Requirements (e.g., Pre-employment medical exam, government benefits forms, bank information, etc))

·         Necessary in order to take steps in entering an Employment Contract with the data subject as signified by the Offer Letter signed by the data subject.

 

·         In compliance with certain laws and regulations

 

·         Within the legitimate interest of SMART as a business and an employer

 

The legitimate interest being pursued by PLDT as hiring employer is to onboard a candidate with a verified credentials or trustworthiness and who is fit to work. The rights and freedoms of the data subject is not harmed given that (a) they Job Application is initiated by the Candidate; (b) the Privacy Notice shall be set up to inform Candidates of the purposes of processing; (c) the Candidates are given the opportunity to delete its own personal data submitted through Candidate Profile or its Career Website Account, or even withdraw job application.

 

·         Data subject’s consent, in relation to processing of Sensitive Personal Information.

 

 

Directly from You;

 

The results from the background investigation are obtained by SMART through its contracted third-party.

 

The pre-employment medical exam results are obtained through the PLDT Medical Services.

 

Candidates who accepted the Employment Offer Letter

 

If you did not pass the evaluation / assessment or you decided to withdraw your application, SMART will retain your information for 6 months from the time of your application. For your pre-employment requirements submitted in physical copies, you are given six (6) months, from the time we sent you a reminder, to pick up those documents. Unclaimed physical copies will be discarded after 6 months.

 

 

Why your personal data is shared

 

SMART shares and/or receives your relevant information to the following third-parties:

1.       PLDT Inc. (PLDT) who owns the Career Site and does the collection of your Candidate Profile and Job Application on our behalf. We also contracted PLDT to conduct your pre-employment medical examination; and to serve as additional manpower to hire some executive-level positions for us.

 

2.        Service provider to conduct background checks for us. We will seek your consent before we collect and share your information (such as Resume, Transcript of Records) to the said third-party. The results of the background checks are received from the same third-party.

 

3.       Third-party platforms to facilitate online assessments. We need to share relevant information about you to enable access to said platform. The results of the assessment are generated by and extracted from the same third-party.

 

In applicable cases where SMART needs to share your personal data to our contractors and partners, SMART will ensure that your personal data is disclosed on a confidential basis, through secure channels, and only in compliance with applicable privacy laws and regulations.

 

If your application progress to hiring and employment, your information (electronic and physical copy) will form part of your employee record and shall follow the existing SMART retention policy.

 

How your personal data is protected

 

The integrity, confidentiality, and security of your personal data is important to SMART. We strictly enforce this Privacy Notice and have implemented technical, organizational, and physical security measures that are designed to protect your personal information from unauthorized or fraudulent access, alteration, disclosure, misuse, and other unlawful activities. We protect your personal data from other natural and human dangers and we require these security measures from all our third-party partners or contractors.

 

 

 

Your rights and choices

 

The Data Privacy Act gives you certain rights to your personal data. Subject to exceptions under the law, you are entitled to request:

1)      Access to the personal data we process about you;

2)      Rectification of your personal data if it is found to be outdated, inaccurate, or incomplete;

3)      Erasure of your personal data in cases where it is no longer needed to achieve the legitimate purpose of its processing;

4)      Restriction of processing of your personal data in limited circumstances;

5)      Portability of your personal data so that you may receive a copy thereof or that we transmit the same to another company on your behalf.
